Consumer Protection Act of 2019.


Consumer Protection Act is to safeguard consumer interest against the purchase of products or services. It works as to protect businesses from involving fraud and unfair business practices. 

Consumer Protection Bill 2019 was introduced in the parliament by Ram Vilas Paswan Minister of Consumer Affairs on 8th July 2019. The bill got the President Nod on 9th August 2019. The bill come in to force on 20th July 2020 as it was specified earlier by the Ministry.

The bill was made an amendment to the Consumer Protection Act 1986, this bill enhances the Speed of  Consumer disputes at the District Level. 


Major Features of Consumer Protection Act 2019(CPA) are,

* CPA gives provision to form central consumer protection authority (CCPA) whose aim is to promote, protect and enforce consumer rights.

   - Conducting investigation against violation of consumer rights
   - Order or Recall of Dangerous Goods
   - Dicontuience of misleading advertisements.
   - imposing penalties against misleading advertisers, such as manufacturers, endorsers and publishers.

*E-commerce Fraud Activities has given provisions to safeguard consumer rights in online purchases.

 E-commerce business is required to provide information to consumers, relating to return, refund,  exchange, warranty and guarantee, delivery and shipment, modes of payment, grievance redressal mechanism, payment methods, the security of payment methods, charge-back options and country of origin

online shopping platforms have to acknowledge the receipt of any consumer complaint within 48 hours and redress the complaint within one month from the date of receipt. They will also have to appoint a grievance officer for consumer grievance redressal.

* Product Liability 
    The seller/Manufacturer has to take responsibility for injury, damage, or any kind loss incurred during the deal or service.

 - Product defect
 - injury in using the product or having services
 - defect in the product specification
 -  faulty at services

*Punishment for manufacturing and selling of  Fake/ Adulterated product.
                In the first conviction, the court may cancel the trade license for 2years, In 2nd Conviction court may cancel the license permanently.

* CPA 2019 has simplified the consumer dispute adjudication dispute, which enables the state and local government to form the law in the protection of consumer rights.
 - It includes Allowing the consumer to file the case through the electronic medium.
 - allows the consumer to file the case at their nearest court.

* there will be no fee for filing the case up to 5lakh.

* CPA 2019, allows forming central consumer protection council. It works as an advisory body headed by the minister of consumer affairs, vice-chairperson, and 34 other members from various fields of experience.
